Acceptance of Terms

By accessing or using Image 2 (the "Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least the age required to form a binding contract in your jurisdiction, or have verifiable parental consent where required by law.

Description of Service

Image 2 provides AI-powered text-to-image generation, credit-based usage, optional subscriptions, a personal generation history, and an optional community gallery where users may publish prompts and images for others to browse.

We may modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practicable.

Accounts

You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately of unauthorized use.

We may suspend or terminate accounts that violate these Terms, our Community Guidelines, or applicable law.

Credits, Billing, and Refunds

• Credits are consumed when you generate images. Pricing and credit grants are shown on our Pricing page and in your account.
• Subscriptions and one-time packs are billed in advance through third-party payment processors. We do not store full payment card numbers.
• Refunds are handled case by case. Contact us at support@gptimage2.com with your order details. Nothing in these Terms limits mandatory consumer rights in your jurisdiction.

Acceptable Use Policy

Image 2 is a text-to-image (AIGC) service. This Acceptable Use Policy is part of these Terms. You agree not to use the Service to generate, upload, publish, distribute, or otherwise make available any prohibited content, including through prompts, reference images, outputs, or the community gallery.

Strict prohibition of NSFW and sexually explicit content

We prohibit sexually-oriented, pornographic, and NSFW content of any kind, including AI-generated content. You must not use the Service to create, upload, store, publish, share, or attempt to generate any of the following, whether private or public:

• Pornography or sexually explicit material of any kind
• Nudity (realistic or stylized) intended to be sexual or erotic
• Sexual acts, sexual posing, or other adult/NSFW imagery
• Fetish, erotic, or sexually suggestive content intended to arouse
• Any prompt, reference image, or workflow designed to bypass this ban

Violation may result in immediate content removal, credit forfeiture, account suspension, or permanent termination without refund, to the extent permitted by law.

Other prohibited uses

You also agree not to use the Service to:

• Violate any applicable law or regulation.
• Infringe intellectual property, privacy, publicity, or other rights of any person or entity.
• Generate, upload, or publish content depicting minors (anyone 17 or under, or who appear to be minors) in a sexual or exploitative manner — zero tolerance, including CSAM.
• Generate, upload, or publish non-consensual intimate imagery (including “deepfakes” or synthetic intimate media of real people without consent) or other illegal content.
• Depict real identifiable people (including celebrities or public figures) in a misleading, defamatory, or sexualized way without their consent.
• Impersonate others, spread malware, spam, or attempt unauthorized access to our systems.
• Circumvent usage limits, credit systems, moderation, or technical protections.
• Use automated means to scrape or overload the Service without our written permission.

We may use automated and manual review (including third-party moderation tools), block prohibited prompts or outputs, remove published content, and suspend or terminate accounts for violations. See our Community Guidelines for rules specific to the public gallery.

Your Content

Prompts, reference images, and outputs

You may submit text prompts, optional reference images, and receive AI-generated images ("User Content"). You represent that:

• You have the rights needed to submit prompts and reference images.
• Your use and publication of outputs complies with applicable law and third-party rights.

We do not guarantee that AI outputs are original, non-infringing, or suitable for any particular purpose. You are responsible for reviewing outputs before commercial or public use.

Publishing to the community gallery

When you choose to publish a generation to the community gallery:

• The image, prompt, and related metadata may become publicly visible to all visitors.
• You grant Image 2 a worldwide, non-exclusive, royalty-free license to host, display, reproduce, distribute, and promote that published content in connection with operating and marketing the Service.
• You may not publish the same generation twice. We may remove, reject, or feature content at our discretion.

Removal of published content does not automatically delete copies already downloaded by others.

Intellectual Property

The Service, its branding, software, and documentation are owned by us or our licensors and protected by intellectual property laws.

These Terms do not transfer ownership of the Service to you. Subject to your compliance with these Terms and applicable law, you retain rights you may have in your User Content, limited by the license you grant us for published gallery items.

Copyright complaints

If you believe content on the Service infringes your rights, follow our Copyright & Takedown Policy. We respond to valid notices and may terminate repeat infringers.

Disclaimers

THE SERVICE AND ALL AI OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant uninterrupted, error-free, or secure operation, or that outputs will meet your expectations.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) USD $100, EXCEPT WHERE SUCH LIMITS ARE PROHIBITED BY LAW.

Indemnification

You agree to defend, indemnify, and hold harmless Image 2 and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or any law.

Governing Law

These Terms are governed by the laws of the jurisdiction where Image 2 operates, without regard to conflict-of-law rules, except where mandatory local consumer protections apply.

Changes

We may update these Terms. Material changes will be reflected by updating the date above. Continued use after changes constitutes acceptance.
